Truck driver not guilty over cyclist's death

A CEMENT truck driver accused of driving dangerously and causing the death of cyclist and gifted musician Richard Pollett has been found not guilty.

The jury retired on Friday morning to consider its verdict after three days of evidence and submissions in the District Court trial in Brisbane, where driver Luke Michael Stevens, 29, pleaded not guilty to dangerous operation of a motor vehicle causing death.

It found Stevens not guilty of dangerous driving causing death on Monday at 10.49am.

Stevens had tears in his eyes as he stepped from the prisoner's dock.

Pollet, 25, was killed after being struck by the cement truck's rear tyres as the driver attempted to overtake him on Moggill Rd at Kenmore at 1.30pm on September 27, 2011.

His devastated parents Patricia and Philip Pollett said outside court they hoped their son's death would remind motorists of their duty of care to one another on the state's roads.

"We all have a duty of care to one another on the roads and we should remember that when all of us are using the roads," Philip Pollett said.

"There is an increasing number of cyclists joining the roads for health reasons and for environmental reasons and we need to exercise that duty of care, especially the drivers of heavy vehicles and especially professional drivers who should know to give cyclists sufficient room."

Judge Michael Rackemann thanked the jury for their efforts during the hearing but told the court he had been left with an "empty feeling".

"It is such an empty feeling in this case because we'd all like to do something to relieve the hurt," he said.

"I can only hope that everyone involved and their families can somehow come to peace in their hearts."

Pollett was a talented violinist and at the time of his death was in Brisbane to play as a soloist with the Queensland Symphony Orchestra.

His peers established the Richard Pollett Memorial Award with the Australian Youth Orchestra to honour his memory and to provide support and encouragement to young violinists after his death.

During the trial, the jury was told Stevens had been driving inbound when he attempted to overtake Mr Pollett in the far left-hand lane of Moggill Rd.

Crown prosecutor Michael Lehane said scratches, gouge marks and "body scuff marks" were found by officers from the Boondall Forensic Crash Unit as far back as 25m from the place where Mr Pollett's body came to rest.

The court heard the force of the impact shattered Mr Pollett's bike helmet. It was told his body had to be disentangled from his mangled bike.

He said Mr Pollett was "vulnerable" as a cyclist and any contact with a vehicle would have obviously "significantly imperilled his life".

Mr Lehane told the jury a heavy vehicle could be more difficult and take longer to manoeuvre.

"The accused should have had an appreciation for how vulnerable Mr Pollett was and insight into how unsettling his vehicle could be," he said.

Mr Lehane argued the road conditions, the vulnerability of Mr Pollett and the restricted capabilities of the heavy vehicle he was driving, should have led Stevens to "put his foot on the brake" as he approached the cyclist.

Barrister Steve Zillman, for Stevens, told the jury his client was going about his lawful business and driving in a responsible way on the day of the accident.

He said Stevens was not driving erratically or speeding and was effectively "boxed in" by other cars as he approached Mr Pollett on his bike.

Mr Zillman said Stevens was under "the honest and reasonable belief" there was enough room on the road to safely overtake him.

He cited the evidence of eye-witness Maxwell Roy Clothier, which contended that Mr Pollett may have come into contact with the cement truck near to the intersection with Blacon St - a straight section of road before the left-hand bend - and therefore "had the option" of turning down it if he felt unsafe.

Mr Zillman said there was no evidence the truck caused Mr Pollett to come off his bike and he could have fallen off as a result of "any number of reasons".

"It's not good enough to say it's a coincidence," he said.

The jury heard Moggill Rd was narrow, winding and the width of the left-hand lane expanded and reduced between 3.1m and 3.6m near to the accident scene, without signage notifying motorists of the change.

Truck driver three times over limit

A B-DOUBLE truck driver has been caught while allegeldy more than three times over the legal limit yesterday at Moura in central Queensland.

Police intercepted the 26-year-old Minden man on Theodore-Moura Rd after they received reports he was driving in an erratic manner on the Dawson Highway about 6.20pm on Sunday.

It is alleged the driver returned a blood alcohol reading of 0.172 per cent.

He will appear in the Biloela Magistrates court on May 27.

AN ELEPHANT has overturned a vehicle carrying two tourists, injuring one of them, in South Africa's Kruger National Park.

The tourists are of "Chinese origin", according to a statement from Kruger National Park.

An elephant in the park attacked the vehicle on a road at 6.30am local time yesterday, and a medical team in a helicopter rushed to help the injured male driver, said the statement.

He was taken to a hospital for further treatment.

It is unclear why the elephant became aggressive, said the park spokesman William Mabasa. He is appealing to the public to be alert in Kruger park and try not to get too close if they see an elephant approaching on the road.

The vast Kruger park lies in South Africa's northeast, next to Zimbabwe and Mozambique.

Taxi driver dies in horror bridge crash

A PERSON has died after a horrific head-on collision between a taxi and another car on the Story Bridge in Brisbane, police say.

The “devastating” crash closed the inbound lanes and cut the outbound lanes on the major road artery from 4.45am Friday, with four people taken to hospital.

The age or gender of the person has not been released.

At 8.40am, police said all lanes of the Story Bridge are re-opened after being closed for almost four hours.

Earlier, motorists were told to avoid the Story Bridge during peak-hour after the two-car crash happened about 4.45am Friday.

A Department of Community Safety spokeswoman said a total of four people were taken to hospital.

All lanes on the Story Bridge heading into Brisbane's city are closed after a head on crash.

“In the private vehicle, there was a female driver who was trapped and she had a male passenger,” she said.

“In the taxi, the male driver was trapped and he had a male passenger.”

The people were taken to either the Royal Brisbane Hospital or the Princess Alexandra Hospital, she said.

The ages and injuries of those hurt was not known.

Queensland Fire and Rescue Service Inspector Mark Welsh said firefighters were forced to use cutting equipment to free the occupants from the cars.

“A person was trapped in their vehicle with serious injuries and it took about three-quarters of an hour to remove them,” he said.

He described the scene as “devastation,” with debris strewn across the road.

“It was a serious incident with bits and pieces off both vehicles,” he said.

Earlier, the Australian Traffic Network said drivers were facing “heavy delays” through the area after authorities closed Main Street inbound at River Terrace and Shaftson Avenue at the Main Street exit due to the accident.

“We advise people to take Vulture Street into South Brisbane and then onto Grey Street, instead, or take the Pacific Motorway to the Riverside Expressway,” reporter Jay Lane said.

Driver aims at cops to avoid RBT

A DANGEROUS driver made a desperate attempt to avoid being stopped at a booze bus in Melbourne's North by driving at a police officer.

Uniformed officers from Fawkner Highway Patrol were manning a breath-testing site on Somerton Rd in Campbellfield at about 11pm on Monday when a Holden captiva station wagon approached.

The driver attempted to drive around the site but was directed to stop.

The man then accelerated towards a police officer who was forced to jump out of the way to avoid being hit.

Registration checks later revealed the car to be stolen.

Less than five hours later, police in Gladstone Park were conducting routine vehicle checks when they spotted the vehicle parked on Carrick Drive.

When they attempted to speak to the driver, the man again drove at police and a short pursuit ensued through Westmeadows and Gladstone Park.

The pursuit was called off due to the high speeds reached by the driver, who was estimated at speeds of up to 100 kmh in a 60 zone.

The trail was picked up again a short time later when the vehicle was seen on Melrose drive, Tullamarine and another pursuit began but was again terminated due to high speeds.

The stolen vehicle was later found burnt out in Kenny St Westmeadows at about 4.45am.

Detectives are investigating and have released a FACE image of a man they wish to speak to in relation to the incident.

He was described as being of Middle Eastern or Southern European appearance and about 20 years old.

He was clean shaven and wearing a white or cream baseball cap at the time of the incident.

THINK you're having a bad day? Spare a thought for this truck driver. He seriously needs lessons in reversing.

The truck was carrying water at Manchester airport when the driver accidently backed into the Easyjet plane, the Manchester Evening News reported.

The truck got stuck. It took three and a half hours to prise it from underneath.

A spokesman for the airline said: "EasyJet can confirm that flight EZY1911 from Manchester to Palma was delayed for around three-and-a-half hours after a service vehicle caused damage to the Airbus A319 aircraft due to operate the flight.

"A new aircraft was brought in to operate the flight which departed around 6pm.

"EasyJet would like to apologise to the passengers for any inconvenience caused."

POLICE have found a car believed to be responsible for a hit-run which left one man with life-threatening injuries and another in hospital.

Police believe the two men were hit by a black Holden Cruze sedan on Malahang Parade in Heidelberg West about 10pm last night.

Residents said they heard a loud bang followed by a woman's screams around the same time, 3AW reports.

A 31-year-old is in a critical condition at the Royal Melbourne Hospital after he was dragged about 40m before being thrown onto the road.

A 32-year-old was treated at the Austin Hospital.

While police still don’t know the identity of the driver, the car was found this morning in a shopping centre car park on Livingston St, Ivanhoe.

Police have spoken to numerous witnesses at the scene but after still trying to piece together the movements of the two injured men before the collision.

The Major Collision Investigation Unit is probing the incident.

Meanwhile, a hoon P-plater had his car impounded after driving at almost 70km over the speed limit in Melbourne’s north last night.

Police from the Fawkner Highway Patrol pulled the driver of the Honda Integra over after clocking him travelling at 147km/h in an 80km/h zone on Sydney Rd, Campbellfield.

The 20-year-old Brunswick West man had his car immediately impounded and its expected to be charged on summons with multiple traffic offences.
